According to an article published in the Bradenton Herald, Circuit Court Judge Janette Dunnigan has finally recused herself from a number or criminal cases.
It appears that Dunnigan only decided to recuse herself because the 2nd District Court of Appeals was about to hear an appeal on the matter. Dunnigan had earlier demised motions filed by criminal defense attorneys asking the Judge to remove herself from a number of cases.
The cause of the controversy stems from an email that came to light through the efforts of an unnamed person who was sifting through Dunnigan’s official emails. One email in particular caused concern among defense attorneys because it appears to show Dunnigan working to raise campaign contributions for Ed Brodsky, who is a candidate for State Attorney in the 12th Judicial Circuit. Brodsky is currently the deputy State Attorney and supervises scores of prosecutors who have hundreds of cases before Dunnigan.
Defense attorneys in the 12th Judicial Circuit expressed concerns that Dunnigan might not be impartial if she is in fact raising campaign contributions for one side (the prosecution) in cases that are before her.
